Our dolphin-safe pledge does not cover orcas. Yes, we know that orca are members of the family Delphinidae, which falls under the Cetacea suborder called Odontoceti, or toothed whales. So yes, all orcas are dolphins and all dolphins are whales. Despite this taxonomical technicality we choose to not make policy of any kind regarding a creature that bullies great white sharks for fun.
